The Singing Guitarists

1. The Promoter

1.1 The Promoter is Phillipa Cookman of The Singing Guitarists, London, United Kingdom (“Promoter”).

2. The Prize Provider

2.1 Phillipa Cookman of The Singing Guitarists, London, United Kingdom is the prize provider ("Prize Provider").

3. How to Enter

3.1 The Competition will run from 20/10/2023 and will close at 23:59 on 03/11/2023 (“Closing Date”).
3.2 The Competition will run across Facebook and Instagram. Entrants will be pooled and one winner will be chosen via random selection.
3.3 To enter the Competition:

3.3.1 You must like at least one of the competition posts on The Singing Guitarists Facebook or Instagram account, uploaded from 20/10/2023.
3.3.2 You must follow or like The Singing Guitarists account on the platform you are entering on.
3.3.3 You must sign up at www.thesingingguitarists.com to receive marketing emails
3.4 The Promoter will not accept responsibility for competition entries that are lost regardless of cause (for example, because of technical malfunction, system, network server computer hardware or software failure of any kind).

4. How to opt out

4.1 If you don’t wish to take part in the Competition, you can opt out of the draw by emailing: [email protected]
4.2 You must opt out before the Closing Date.

5. Eligibility

5.1 No purchase is necessary to enter.
5.2 The Competition is open only to UK residents (excluding employees of the Promoter, third parties involved in the Competition and their families) who are aged 18 and above.
5.3 Entries must not invade the privacy or other rights of any person, firm or entity, and must not in any other way violate applicable laws and regulations or network standards.
5.4 All elements appearing in a participant’s entry must be entirely original, created by the participant. Entries must not contain or reference any third party copyrighted works or trademarks and must not infringe the intellectual property rights of any third party.
5.5 For the avoidance of doubt, there is a limit of one prize across both posts and across both platforms - Instagram and Facebook.

6. The Prize Package

7. The Winner

7.1 The winner will be selected at random from the pool of valid applicants and contacted by the Promoter by 5/11/2023.

7.1.1 The Promoter will contact the winner via direct message on the platform they entered on (Instagram or Facebook respectively).
7.1.2 The winner will have 5 days to confirm acceptance of prize otherwise a new winner will be identified and contacted.
7.1.3 The winner will be required to provide photographic identification matching the username on the social platform entered on.

7.2 The decision of the Promoter is final, and no correspondence or discussion will be entered into.
7.3 The Promoter reserves the right, in its sole discretion, to disqualify or exclude any individual for inappropriate behaviour including but not limited to:

7.3.1 Tampering with the entry process, (including exceeding any limitation on the numbers of entries allowed), or any other process, which, in the opinion of the Promoter in any way affects the fairness of the Promotion.
7.3.2 Tampering with the operation of the Promotion or the website of the Promoter.
7.3.3 Acting in violation of the terms of the Promotion.
7.3.4 Violating the terms of service, conditions of use and/or general rules or guidelines on the social networking site.
7.3.5 Acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person.
7.3.6 Any conduct which would put other entrants at an unfair disadvantage.

7.4 The winners' names and counties will be available on request by contacting the Promoter on [email protected]

7.4.1 If you object to your surname and counties being made available, please contact the Promoter at [email protected]. However, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request.

7.5 The Promoter may ask you to take part in publicity relating to the competition, but you do not have to agree to this.
7.6. The Promoter may ask you to complete a feedback form relating to the contact process and the competition, but you do not have to agree to this.
7.7 Any personal data submitted by the winner to the Prize Provider will be treated in accordance with Prize Provider’s privacy policy, which is accessible at https://www.thesingingguitarists.com/privacy-statement

8. Claiming the Prize

8.1 The winner will be contacted by the Prize Provider by 5/11/2023.
8.2 The Prize may not be claimed by a third party on your behalf.
8.3 The Promoter will make all reasonable efforts to contact the winner via Instagram direct message or Facebook private group. If the winner does not respond to the Promoter to claim their prize within 5 days of the Promoter's contact, or should the winner be uncontactable due to privacy settings meaning they are uncontactable on the platform, the Promoter reserves the right to offer the Prize Package to the next eligible entrant selected from the valid entries that were received before the Closing Date.
8.4 The winner will have to provide the promoter with their address for postage purposes. This will be treated in accordance with Prize Promoter’s privacy policy.

9. Limitation of Liability

9.1 The Promoter shall not be liable for any failure or omission to comply with its obligations where the failure or omission derived by circumstances outside its reasonable control.

10. Data Protection and Publicity

10.1 Personal data supplied during the course of the Competition will be used for email marketing purposes in accordance with Prize Promoter’s privacy policy.

11. Intellectual Property

11.1 By entering into this Competition, you consent to The Singing Guitarists using, altering and modifying your entry for promotional activity such as re-publishing and sharing the content on other social media sites.

11.2 The winner(s) forever waives any rights of privacy, intellectual property rights, and any other legal or moral rights that may preclude the Promoter’s use of the winner(s)’s entry or require the winner(s)’s permission for the Promoter to use them for any purpose, and the winner(s) agrees to never sue or assert any claim against the Promoter’s use of those materials.

12. General

12.1 If there is any reason to believe that there has been a breach of these Terms and Conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the Competition.
12.2 The Promoter reserves the right to amend these Terms and Conditions at any time without notice.
12.3 These Terms and Conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.

13. Social Media

13.1 All entrants agree to a complete release of TikTok, Meta, Instagram and Facebook by each entrant or participant; and acknowledgement that the promotion is in no way sponsored, endorsed, administered by or associated with TikTok, Facebook, Instagram and Meta
